SCOTUS Grants Cert in Criminal Case

On February 27, 2023, Shay Dvoretzky and Parker Rider-Longmaid secured a grant of certiorari on behalf of Mark Pulsifer in Pulsifer v. United States, No. 22-340 (U.S.). This is an important criminal case regarding the safety valve for nonviolent drug offenders from onerous mandatory minimum sentences (18 U.S.C. § 3553(f)). The courts of appeals are split 3–4, and the federal government, in a rare move, agreed that the Court should review the case.

Pulsifer is the seventh merits case Skadden’s Supreme Court and Appellate practice will handle since launching just over two years ago at the end of 2020.
