Litigation and Government Enforcement Litigation

Gary A. Rubin, a counsel in the firm’s Washington, D.C. Litigation and Government Enforcement Group, represents individuals and domestic and foreign companies in civil and criminal investigations, complex litigation, and parallel proceedings involving private litigants and state, federal, and foreign regulators and prosecutors. He also advises clients on federal and foreign anti-corruption compliance issues. Mr. Rubin primarily focuses on conducting internal corporate investigations with significant overseas components involving the U.S. Foreign Corrupt Practices Act and federal securities and fraud statutes, as well as foreign anti-corruption laws. He frequently addresses conflicts of laws, cross-border discovery issues, and data-protection issues.

Mr. Rubin also represents debtors, creditors, financial advisors, targets, and acquirers in litigated proceedings in and related to Chapter 11 bankruptcy cases. His representations include: engineering and construction companies The IT Group, Inc. and Stone & Webster, Incorporated as debtors in their Chapter 11 cases; financial advisor UBS Securities LLC in litigation against NationsRent, Inc. in its Chapter 11 case; and power producers Colstrip Energy Limited Partnership and Yellowstone Energy Limited Partnership in litigation against public utility Northwestern Corporation in its Chapter 11 case.

Mr. Rubin writes on crisis management in parallel proceedings, cross-border discovery, subprime litigation, and European class action and securities litigation. He lectures on conducting internal investigations and managing cross-border discovery and data-protection issues.
