Intellectual Property and Technology

Chuck P. Ebertin is a partner in Skadden’s Intellectual Property and Technology Group and is resident in the Palo Alto office.

Mr. Ebertin’s practice focuses on intellectual property litigation, including patent, copyright and trade secret issues, as well as contract litigation arising from technology licensing. He has litigated patents relating to semiconductor circuit design and semiconductor manufacturing equipment and processes, wireless communication systems, encryption and error control coding algorithms, e-commerce, Internet applications and other software technologies. Mr. Ebertin also has represented high-technology companies in license negotiations and settlement discussions in addition to working with clients to develop intellectual property strategies.

Representative matters include:

  • Applied Materials, Inc. in patent litigation involving plasma enhanced chemical vapor deposition; methods and devices for chemical mechanical polishing; laser pattern generators used in photomask creation; equipment for automatic wafer defect detection/optical inspection; heat transfer thermodynamics, methods and processes for chemical vapor deposition of tungsten; and methods and systems for depositing metal via physical vapor deposition;

  • Moser Bear India Limited in patent litigation involving numerous aspects of the structure and design of optical media, including CD-R/CD-RW, DVD+R/DVD+R and DVD-R/DVD-RW technologies;

  • eBay Inc. in patent litigation involving user manipulated database entries and on-line searching functionality;

  • Qualcomm Inc. in patent litigation involving various aspects of digital telecommunications;

  • Lipstream Networks, Inc. in patent litigation concerning Internet group messaging services;

  • Zenith Electronics in its patent licensing program relating to methods and devices for generating and processing signals for terrestrial broadcast of high-definition television signals;

  • Sun Microsystems in patent litigation involving methods for allowing computers having different binary structures to share information in a standardized binary format;

  • Exar Corp. in patent litigation involving various aspects of read/write circuitry used in disk drive applications;

  • National Semiconductor in patent litigation, both in district court and before the International Trade Commission, involving methods to prevent corrosion of plasma-etched aluminum films and various circuits useful in semiconductor memory applications; and

  • Intel Corp. in copyright litigation involving in-circuit emulation microcode.

Mr. Ebertin has been named by Bay Area Lawyer Magazine among the “Best Lawyers in the Bay Area.” Prior to private practice, Mr. Ebertin served as an extern to the Honorable Spencer Williams of the U.S. District Court, Northern District of California and as intellectual property litigation counsel at Applied Materials, Inc.
