David Clancy handles individual and class action lawsuits in federal and state court, at the trial and appellate level. His cases have included breach of contract, securities, sales practices, trade secret and noncompetition cases and, in various contexts, temporary restraining order/preliminary injunction proceedings.

Mr. Clancy’s experience includes representing a national insurer in New York attorney general investigations concerning health insurance; a mutual fund adviser in an Investment Company Act Section 36(b) suit alleging “excessive” management and distribution fees; a New York corporation in class action lawsuits challenging its employee stock purchase plan under state wage statutes and Rule 10b-5; a movie theater chain in a U.S. Department of Justice Americans with Disabilities Act enforcement action; plaintiff corporations in noncompete/theft of trade secrets lawsuits and in Freedom of Information Act lawsuits filed against state and federal environmental regulators; life insurance companies in purported class and individual sales practices cases in multiple states; and health insurers in individual and class action lawsuits in multiple states concerning marketing and pricing practices.

Mr. Clancy also is active in providing pro bono representation. For example, he argued and won the reversal and remand, by the U.S. Court of Appeals for the First Circuit, of a Justice Department denial of political asylum; he was appointed a special assistant district attorney with the Middlesex County Office of the District Attorney to oppose a defendant’s appeal from an assault-and-battery conviction (which was affirmed); and he has represented Brookview House, a Massachusetts low-income housing organization, as well as Paralyzed Veterans of America. In 2009, he was recognized in The National Law Journal’s “2009 Appellate Hotlist” for his work on a First Circuit pro bono appeal.

Mr. Clancy is a member of the board of editors of the Boston Bar Journal, and a member of the Boston Bar Association’s Pro Bono Committee, and its Task Force on Out-of-Work Attorneys. He is also a participant in the Boston Chamber of Commerce’s 2010 Boston’s Future Leaders program.

Mr. Clancy repeatedly has been selected for inclusion in Chambers USA: America’s Leading Lawyers for Business.

He is admitted to practice in New York, Massachusetts and in the following federal courts: U.S. Supreme Court, U.S. Court of Appeals for the First and Seventh Circuits and U.S. District Court for the District of Massachusetts.
