Steven F. Napolitano represents defendants in complex mass tort, class action, and products liability litigation. Representative clients of Mr. Napolitano have included manufacturers and distributors of asbestos and asbestos-containing products, pharmaceutical products and medical devices, heavy machinery, food and beverages, and other consumer products. He is also presently defending a national youth-serving organization in litigation involving allegations of child sexual abuse.
Mr. Napolitano has been involved in all aspects of strategic litigation planning and defense, including litigation management, expert development and discovery, electronic discovery and appellate practice. He has authored briefs in courts through the United States on a wide array of evidentiary and other legal issues. He regularly counsels U.S. and international companies with regard to product liability risk and jurisdictional issues. Mr. Napolitano also represents clients in mediations and arbitrations.
Mr. Napolitano advises clients on product recall issues involving the U.S. Food and Drug Administration and the U.S. Consumer Product Safety Commission. His work in this area includes all aspects of product recall planning and execution, including drafting recall procedures and protocols, managing recall effectiveness, media planning, and assessing insurance and litigation issues. Mr. Napolitano advises clients on product liability risk assessment in connection with product development and marketing. He has prepared warnings and other written materials for product manufacturers.
Mr. Napolitano also advises financial and investment clients of the firm in connection with product liability and tort litigation risks arising in connection with potential mergers, acquisitions, asset purchases and other corporate transactions. His clients have included public and private companies, investment banks and private equity firms. He has advised corporate and financial clients on a large number of complex transactions involving asbestos, silica, and other mass tort and product liability risks. A number of those transactions have involved foreign purchasers of business interests in the United States.
Mr. Napolitano is an author and lecturer on U.S. product liability issues. He has served on Law360’s Product Liability Editorial Advisory Board.
Mr. Napolitano also is active in providing pro bono representation. His pro bono activities have included advising The Innocence Project, Lincoln Center for the Performing Arts and the New York Restoration Project.
