James Falconer’s practice encompasses advising practitioners, creditors and debtors on all aspects of insolvency and restructuring, with a particular focus on the representation of Europe-based debtors in cross-border restructuring transactions.

Bio

Mr. Falconer is experienced in the use and integration of restructuring and insolvency proceedings in various jurisdictions, particularly in the use of schemes of arrangement and Chapter 11 cases.

He also has significant experience in relation to contentious matters, including insolvency-related litigation and arbitration.

His recent experience also includes advising:

  • Roust Trading Limited, the ultimate shareholder of Russian Standard Bank, in a U.K. court-sanctioned scheme of arrangement to restructure two series of Eurobonds in the amount of US$550 million
  • TORM A/S, a shipping company in Denmark, in its US$1.4 billion financial restructuring via a scheme of arrangement
  • Nautilus Holdings Limited, a Cyprus-based container shipping company, in its restructuring through a Chapter 11 case in the U.S. Bankruptcy Court for the Southern District of New York
  • Excel Maritime Limited, a shipping company based in Greece, and 37 of its wholly owned subsidiaries in a prenegotiated Chapter 11
  • the valuation experts in connection with the €600 million debt restructuring of ATU Auto-Teile-Unger Holding GmbH, a car repair chain owned by private equity firm KKR & Co. L.P.
  • Better Place, Inc., an electric vehicle company, in relation to its Israeli liquidation and the winding up of its global operations

Prior to joining Skadden, Mr. Falconer practiced at a leading insolvency firm in Sydney, Australia, where he acted principally for secured creditors and insolvency practitioners. He completed his LLB with First Class Honours at the University of Adelaide, Australia in 2005. He was awarded numerous academic prizes, including the Thompson Playford prize and medal as most outstanding graduate.

Mr. Falconer has been recognized as a Rising Star in Restructuring and Insolvency by IFLR1000. He is a member of the International Insolvency Institute’s NextGen Leadership Programme and is a member of the Insolvency Lawyers Association.
