Skadden represented Miraca Holdings, Inc. in securing the dismissal of claims brought by a qui tam relator under the federal False Claims Act and the California and North Carolina state analogues. On July 14, Judge Pamela A. Barker of the U.S. District Court for the Northern District of Ohio dismissed the relator’s claims in their entirety for failure to state a claim, finding that the complaint did not contain any allegations that Miraca Holdings, Inc. itself participated in the alleged fraudulent scheme or had a role in the alleged submission of false claims.
