The Commodity Futures Trading Commission (CFTC) announced that the Global Markets Advisory Committee (GMAC) will hold a public meeting on February 12, 2014, to discuss CFTC Staff Advisory 13-69 (Staff Advisory).

The Staff Advisory interpreted the CFTC’s Cross-Border Guidance to require a non-U.S. swap dealer to comply with particular CFTC regulations when it enters into a swap with a non-U.S. counterparty if the swap is arranged, negotiated or executed by personnel or agents of the non-U.S. swap dealer located in the U.S.

You can find Skadden’s analysis of the CFTC’s Cross-Border Guidance here and analysis on the Staff Advisory here.

The GMAC meeting will be held at the CFTC’s Washington, D.C. headquarters from 2-5 p.m. on Wednesday, February 12, 2014. The meeting will also be broadcast on a live audio call-in telephone feed. Dial-in details are available here.

The deadline to submit written statements in connection with the meeting is February 6, 2014.
