The Staff Advisory interpreted the CFTC’s Cross-Border Guidance to require a non-U.S. swap dealer to comply with particular CFTC regulations when it enters into a swap with a non-U.S. counterparty if the swap is arranged, negotiated or executed by personnel or agents of the non-U.S. swap dealer located in the U.S.
