Christopher A. Lisy’s practice includes intellectual property litigation, financial services and insurance product litigation and other forms of complex civil litigation. Mr. Lisy also represents companies involved in mergers and acquisitions to provide counsel about litigation risk, indemnification arrangements and other issues.
In recent years, Mr. Lisy has secured several notable and high-profile jury verdicts in U.S. District Court. For example, in a case involving “virtual reality” intellectual property in the U.S. District Court for the Northern District of Texas, Mr. Lisy and a trial team obtained a $500 million jury verdict on behalf of a video game company against Facebook subsidiary Oculus VR and its executives for copyright infringement, breach of contract and false designation. The verdict is the sixth-largest ever awarded for copyright, trademark and/or trade secret claims and the 12th largest intellectual property verdict including patent damages.
Mr. Lisy and a trial team also obtained a multimillion dollar jury verdict, damages award and permanent injunction for copyright infringement and trade secret misappropriation on behalf of a technology company in the U.S. District Court for the Southern District of Texas. In another action in the U.S. District Court for the Eastern District of New York, Mr. Lisy successfully defended a software development firm against a preliminary injunction for copyright infringement sought by a global technology firm. In connection with these matters and others, Mr. Lisy has litigated issues concerning proprietary computer source code and open source code (including HLASM, C++ and C#), 3D gaming and “first-person” games, as well as commercial software products in the storage, replication, database, and planning and scheduling areas, among others.
Mr. Lisy litigates non-competition and confidentiality agreements in Massachusetts state courts and federal courts, particularly on behalf of clients in technology industries. He has obtained numerous preliminary and permanent injunctions for his clients, including in “employee raiding” cases, and successfully has defended against such injunctions as well.
In addition to this intellectual property work, Mr. Lisy’s practice includes the representation of the world’s largest financial services firms and their directors, officers and executives in complex litigation, regulatory investigations and mergers and acquisitions. These proceedings include class actions and shareholder derivative proceedings for securities fraud, breach of contract and breach of fiduciary duty. For example, Mr. Lisy represents several insurance companies in ongoing disputes at the trial and appellate level over changes to “cost of insurance” charges and other “non-guaranteed elements.” He also obtained the dismissal of several shareholder litigations concerning auction rate securities for a Massachusetts investment adviser and its chief executive officer.
Mr. Lisy also represents companies in a broad range of regulatory investigations and enforcement actions by the U.S. Securities and Exchange Commission, the U.S. Department of Justice and state regulatory agencies concerning, for example, insider trading, disclosure issues and internal controls.
Mr. Lisy is admitted to practice in Massachusetts, New York and Rhode Island, as well as numerous federal courts across the country.
