Tom Southwell focuses on international arbitration and commercial litigation.

Mr. Southwell has experience in international arbitration proceedings under the rules of the major arbitral institutions and with cases before all levels of the English courts. He handles a broad range of commercial disputes, particularly in the oil and gas, energy and financial services sectors, and arising out of share sale transactions, joint ventures and civil fraud.

Examples of Mr. Southwell’s recent engagements include representing:

  • ATK Energy EU Ltd (formerly EnergySolutions EU Limited) in proceedings in the Technology and Construction Court, Court of Appeal and Supreme Court concerning the company’s successful challenge to a public procurement in relation to the decommissioning of the Magnox nuclear sites in the U.K.;
  • Interbrew Central European Holding BV in its successful €120 million High Court claim against Starbev LP in relation to an earn-out following the sale of a major European brewing business;
  • a consortium of Middle Eastern oil and gas companies in two multibillion-dollar LCIA arbitrations relating to the exploitation of oil and gas assets in Iraq; and
  • parties in a joint venture in relation to a put option right and various other claims totalling in excess of US$500 million arising out of the operation of a major Eastern European machine-building enterprise.
