Intel Wins Dismissal at Illinois Supreme Court

The Illinois Supreme Court recently dismissed a Madison County class action against Skadden client Intel Corp., holding that neither a nationwide class nor a statewide class could be maintained. The decision is important for two reasons. First, it refused to use the law of the manufacturer's residence to make a nationwide class manageable. Second, the court held that a statewide class was not maintainable because the alleged misrepresentations were puffery and thus not legally actionable, and any other representations pled had not been received and relied upon by the entire class.
