Summit Medical Center Secures Victory in Qui Tam Action

Skadden client Sutter Health Systems and its Summit Medical Center have prevailed in an appeal before the U.S. Court of Appeals for the Ninth Circuit. The Ninth Circuit on May 14 affirmed a ruling by the U.S. District Court for the Northern District of California, dismissing for lack of subject matter jurisdiction a qui tam action brought against Summit under the federal False Claims Act. The panel concluded that the plaintiff/relators in the action did not qualify as "original sources" of the information underlying their allegations as required by the False Claims Act.
