Skadden secured the dismissal of a False Claims Act qui tam action filed against Ascension Health and three affiliated Tennessee hospitals alleging the defendants submitted false claims to Medicare for ultrasound tests that did not meet local coverage criteria. On November 18, Judge Todd J. Campbell of the U.S. District Court for the Middle District of Tennessee ruled that the plaintiff's amended complaint failed to identify "a single specific claim which was submitted to Medicare for payment” and dismissed the case with prejudice and without leave for the plaintiff to amend.
