Skadden secured a victory in the Texas Supreme Court for Port Arthur Steam Energy, L.P. in a long-running battle with Oxbow Calcining LLC over an arbitration award favoring PASE. Although the district court initially vacated the award, Skadden succeeded in obtaining a reversal in the court of appeals. On October 24, the Texas Supreme Court denied Oxbow’s petition to review the court of appeals’ decision to confirm the arbitration award.
