Electrolux Secures Reversal of Class Certification

On behalf of Electrolux, Skadden secured the reversal of a class certification ruling in a suit brought by plaintiffs seeking compensation in connection with thousands of allegedly defective washing machines. On March 21, the U.S. Court of Appeals for the Eleventh Circuit reversed and remanded the lower court's ruling that previously granted certification to a class of washing machine purchasers. In its application, the Eleventh Circuit ruled that the consumer fraud claims are not amenable to class treatment, and the district court must reconsider the warranty claims under the proper, higher standard for class certification following Supreme Court rulings such as Dukes and Comcast.
