Univ. of North Carolina Wins Affirmance in Student-Athlete Case

Skadden secured a highly favorable result for the University of North Carolina (UNC) by persuading the North Carolina Court of Appeals to unanimously affirm the lower court's dismissal with prejudice of claims brought by former UNC student-athletes. The putative class action alleged that the university breached its contract with student-athletes because they were purportedly denied a high-quality education and directed to low-quality courses. Following extensive briefing and oral argument, the court affirmed the trial court's dismissal based on a lack of standing for failure to allege a sufficient injury.
