DC Circuit Reverses FERC, Vacates PJM Minimum Offer Orders

On July 7, the U.S. Court of Appeals for the D.C. Circuit vacated Federal Energy Regulatory Commission (FERC) orders that authorized broad exemptions from the PJM Interconnection, L.L.C. Minimum Offer Price Rule, holding that FERC exceeded its authority under the Federal Power Act. Skadden represented PJM Power Providers.
