The Eleventh Circuit affirmed the dismissal with prejudice of a putative class action filed against Intuitive Surgical asserting claims for negligence, strict liability and punitive damages. The plaintiffs alleged that Intuitive's surgical robot caused metal debris to travel to their brains. The court agreed with Intuitive that the plaintiffs' claims failed as a matter of Georgia law because the plaintiffs failed to allege a cognizable injury.
