Pan American Health Organization Secures Settlement of Arbitration

Skadden represented the Pan American Health Organization (PAHO) — the Regional Office for the Americas of the World Health Organization — in securing a favorable settlement of a dispute between PAHO and Uniting for Health Innovation (UfHI) relating to UfHI’s infringing uses of PAHO’s trademarks. In its demand for arbitration, PAHO alleged that UfHI breached the affiliation agreement between the parties by using PAHO’s name without authorization and failing to pay outstanding balances to PAHO after terminating the agreement. UfHI continued to publicly refer to itself as “PAHO Foundation,” which PAHO argued created confusion as to a continued affiliation between the two organizations when no such relationship existed. Skadden secured a settlement that included a stipulated permanent injunction, cancellation of UfHI’s infringing trademark registration and a confidential monetary payment to PAHO.
