Matthew Bender Secures Denial of Motion for Reargument

Skadden represented Matthew Bender & Co. in securing a rejection of the plaintiffs’ motion for reargument of the Appellate Division, First Department’s May 2 decision and order unanimously affirming the dismissal of a putative class action that Skadden had previously secured in the Supreme Court for New York County. The plaintiffs had claimed Matthew Bender was liable for breach of contract, fraud and consumer deception due to alleged inaccuracies in its annual “Tanbook” publication. The Appellate Division agreed with the lower court’s dismissal of all claims.
