On March 27, a unanimous panel of the U.S. Court of Appeals for the First Circuit affirmed the dismissal of a putative nationwide class action filed against eClinicalWorks, LLC (eCW) for lack of Article III standing. The lawsuit had been filed by the estates of two patients whose medical records supposedly contained inaccuracies as a result of alleged glitches in eCW’s electronic health care records software. Skadden convinced a district court judge to dismiss the lawsuit outright on the ground that the estates failed to plead a cognizable injury-in-fact.
