DuPont and Corteva Win Dismissal of ERISA Claims

Skadden secured a dismissal with prejudice of ERISA claims against DuPont de Nemours Inc. and Corteva Inc., along with several affiliated entities, arising from a corporate restructuring involving the merger of DuPont and Dow Chemical and spin-off into three separate companies. Judge Yvonne Gonzalez Rogers of the U.S. District Court for the Northern District of California previously dismissed the plaintiffs’ then-operative seven-count complaint, but granted the plaintiffs leave to amend to attempt to cure the deficiencies she identified. The court has now dismissed the sole remaining claim in the plaintiffs’ complaint with prejudice.
