Dell Secures Dismissal of Qui Tam Action

Skadden secured the dismissal of a qui tam action against Dell Computer Corporation that alleged the company sold computer systems containing undisclosed security vulnerabilities to the United States government. Judge Thomas Hogan of the U.S. District Court for the District of Columbia rejected this argument and dismissed the relator’s claim on October 8, 2020, after finding that he failed to state a claim under the False Claims Act. The relator’s motion for leave to amend the complaint was denied on March 29, 2022, after Judge Hogan again rejected the relator’s proposed amended allegations.
