Bio

Mr. Tabak is experienced in death penalty and civil rights litigation. Among other matters, he successfully argued the U.S. Supreme Court death penalty case Francis v. Franklin and played a lead role in securing Georgia inmate Johnny Lee Gates’ removal from death row after 26 years. Mr. Tabak has chaired the Committee on Civil Rights of the Association of the Bar of the City of New York and co-chaired the New York State Bar Special Committee on Re-Entry, and is chair of the Death Penalty Committee of the American Bar Association’s Section of Civil Rights and Social Justice. In addition, he chaired the ABA Section of Civil Rights and Social Justice’s Task Force on Mental Disability and the Death Penalty, whose proposals have been adopted as policies by the ABA, the American Psychological Association and the American Psychiatric Association.

He has spoken on a range of topics, including pro bono, fellowships, capital punishment, habeas corpus and civil rights, at numerous law schools, bar associations and civic groups, as well as on radio and TV. He has written numerous articles on such subjects and, beginning in 2007, has authored the Capital Punishment chapter in the ABA Criminal Justice Section’s book, The State of Criminal Justice. In 2017, Mr. Tabak organized and moderated an ABA/New York City Bar Association panel discussion on the experiences of the seven states that had already abolished capital punishment in recent years and the implications for states that still have the death penalty. In August 2018, he organized and moderated an ABA program featuring Cardinal Blase Cupich of Chicago concerning whether capital punishment, as now implemented, comports with evolving standards of decency.

In addition, Mr. Tabak is experienced in energy, contract, antitrust, securities and entertainment litigation. He has been a principal litigator in complex litigation concerning the syndication of television programming. Mr. Tabak has worked with attorneys from the firm’s Los Angeles office to secure favorable rulings in arbitration, court proceedings and administrative proceedings concerning the operations of North America’s largest-producing oil and gas field.
