On June 17, Skadden hosted the webinar “Analyzing Recent FCA Developments,” which covered recent False Claims Act (FCA) settlements, new health care fraud and abuse laws across the country, and recent enforcement and litigation trends. Skadden speakers included Washington, D.C. litigation partner Bradley Klein, white collar defense and investigations partner Jessie Liu, Los Angeles litigation partner Matthew Sloan and Palo Alto partner Quyen Ta. The panelists examined the constitutionality of the qui tam provision, explored causation in Anti-Kickback Statute (AKS)-based FCA cases and analyzed the FCA scienter standard. Additionally, the panel assessed developments in Medicaid funding cases and related implications on future enforcement, and discussed recent tariff evasion cases.
