The Current State of Nationwide Injunctions

Partner Lauren Aguiar provides an update on the caselaw and policy surrounding nationwide injunctions. Injunctions in general are an extremely useful tool for civil litigators, and nationwide injunctions can be especially powerful. They have been on the rise over the last few decades, yet there is little in published judicial opinions or academic literature regarding systematic treatment of this phenomenon or how to evaluate the appropriate scope of such an injunction.
