Michael Bailey’s practice focuses on representing financial institutions, corporations and individuals in complex civil litigation in federal and state courts, and in investigations and proceedings brought by the Securities and Exchange Commission and other federal and state agencies.


Mr. Bailey represents a wide variety of clients in civil litigation, with an emphasis on actions brought under federal securities laws and matters involving the health care industry and the False Claims Act. He has extensive experience counseling at all stages of the litigation process, representing clients in jury trials, government investigations, appeals and arbitrations. He also has assisted in conducting internal investigations of potential corporate misconduct.

Representative clients include:

  • a software developer and information technology provider, and former officers, in a consolidated shareholder federal class action that settled favorably involving alleged violations of federal securities laws in connection with statements concerning the company’s work on contracts with the U.K.’s National Health Service;
  • a former CEO of a major pharmaceutical company in several consolidated shareholder federal class actions involving alleged violations of the federal securities laws;
  • a pharmaceutical company in connection with federal and state court litigations and related government investigations;
  • an underwriting syndicate of underwriters of note offerings in a class action involving alleged misstatements in various notes offerings;
  • a government subcontractor in a three-week jury trial in federal court involving claims of discrimination, breach of contract, tort and conspiracy that resulted in favorable verdicts;
  • a real estate investment trust in a fraud and fiduciary duty suit in state court against a broker that resulted in summary and default judgments in favor of the client;
  • a state contracting agency in a two-week jury trial in state court involving claims of breach of contract that resulted in a verdict in favor of the client; and
  • a congressman in a multiyear investigation by the Public Integrity Section of the Department of Justice.

Mr. Bailey participates in a number of community service activities and pro bono representations.
