
Rene H. DuBois
Bio
Rene DuBois represents clients in a wide range of complex civil litigation matters, including securities and shareholder derivative litigation, financial services, insurance, civil and criminal government investigations and internal investigations. Mr. DuBois has successfully defended clients in putative class action matters in state and federal trial and appellate courts around the U.S. He also has successfully defended various life sciences and insurance companies in False Claims Act (FCA) investigations and qui tam litigation, in addition to counseling clients in these sectors on matters involving fraud and abuse laws, including federal and state anti-kickback laws. In recognition of his work, Mr. DuBois has been named one of Best Lawyers’ Ones To Watch in America.
Representative matters include:
- an insurance company in FCA suits involving the Medicare Secondary Payer Statute — all claims were dismissed and affirmed on appeal by the U.S. Court of Appeals for the Second Circuit
- a medical device manufacturer in an FCA investigation by the Department of Justice (DOJ) involving co-marketing programs
- a medical device manufacturer in an FCA investigation and qui tam litigation involving rebate agreements
- a management consultant company in the dismissal of an FCA suit involving a Medicare Advantage program
- a leading genomic laboratory in a self-disclosure of health care fraud and abuse concerns as well as the subsequent government investigation
- a leading molecular diagnostics company in an FCA investigation by the DOJ involving Medicare billing rules
- a Medicare Advantage organization in an FCA investigation by the DOJ involving an incentive program
- a consumer robotics company in securing the dismissals of several putative securities class actions
- a cannabis and consumer packaged goods company in securing the dismissal of a putative securities class action concerning a financial restatement
- a pharmaceutical company in securing the dismissal of a putative securities class action following the Food and Drug Administration’s (FDA’s) disclosure of safety events concerning an approved drug, which was subsequently affirmed by the U.S. Court of Appeals for the Second Circuit
- a biotechnology company in a putative securities class action following the withdrawal of a new drug application to the FDA
- an insurance company in several class action lawsuits concerning the implementation of a volatility management strategy in certain portfolios of variable annuity and life policies
- various insurance companies in class actions alleging purported violations of the Medicare Secondary Payer Statute
Mr. DuBois has an active pro bono practice and has represented various state prisoners in civil rights litigation in federal courts and a law professor as amicus curiae in a federal appeals case involving a venture capital firm’s charity.
While in law school, Mr. Dubois interned for the Hon. George B. Daniels in the U.S. District Court for the Southern District of New York. He is an active member of the Boston Bar Association and Hispanic National Bar Association.
