Bio
Will Eberlee acts on behalf of plaintiffs and defendants in a range of complex commercial disputes, including claims for breach of contract, fraud, tortious interference and breach of fiduciary duty, as well as in antitrust and securities actions.
Representative matters in state and federal courts include:
- Rithm Capital in actions in New York and Delaware seeking to enjoin Rithm’s acquisition of Sculptor Capital Management
- The Port Authority of New York and New Jersey in connection with the development of John F. Kennedy Airport’s New Terminal One and multiple lawsuits arising out of the construction of the George Washington Bridge Bus Station
- Brightline Holdings LLC in an action related to the financing of the Brightline West high-speed rail project
- JPMorgan Chase in antitrust class actions and other litigations alleging a conspiracy among Visa, Mastercard and certain banks related to credit and debit “interchange” fees and related network rules
Mr. Eberlee has also represented a private equity firm, professional sports league, pharmaceutical company and estate trust, among others, in individual or multidistrict litigations throughout the United States. He has provided strategic advice in connection with a variety of corporate transactions, including on behalf of a major bank in Mexico, a software developer in California, and airline and infrastructure companies in South America.
He maintains an active pro bono practice and has represented clients in housing, immigration, disability and education matters.
