Henry Eisenberg has represented clients in connection with their obligations under most of the major environmental statutes, including the Comprehensive Environmental Response, Compensation and Liability Act, the Resource Conservation and Recovery Act, the Clean Air Act, the Clean Water Act and analogous state statutes.


Mr. Eisenberg’s practice involves environmental litigation and counseling, including negotiating with state regulators concerning permit and other requirements under the Clean Air Act and advising clients with respect to the environmental issues arising from business transactions. He has performed or supervised environmental due diligence investigations in connection with corporate, energy, financial and real estate transactions in the United States and internationally and frequently negotiates environmental contract provisions with respect to such transactions.

He has been extensively involved in environmental issues arising from the deregulation of the United States electric power generation industry, representing buyers, sellers and lenders. Mr. Eisenberg has conducted or assisted clients with due diligence, contract negotiations and environmental regulatory compliance in connection with numerous such transactions over the last 14 years.

Mr. Eisenberg has served as a faculty member at the Environmental Law Institute’s annual “Boot Camp” program, which provides an introduction to environmental law for attorneys and other professionals.
