Brittany Libson advises clients on government enforcement, regulatory and internal investigations, with a focus on criminal and civil matters involving the Department of Justice (DOJ), the Securities and Exchange Commission (SEC), the Commodity Futures Trading Commission (CFTC), the Federal Trade Commission (FTC) and other government authorities.
Bio
Ms. Libson represents corporations and individuals in a broad range of white collar defense and compliance matters, including those involving criminal antitrust investigations, securities enforcement, the Foreign Corrupt Practices Act (FCPA), cybersecurity and digital assets.
Ms. Libson’s representations have included, among others:
- a major U.S. corporation in a criminal antitrust investigation into alleged international price fixing, which closed without charges
- a SPAC sponsor in a securities fraud enforcement investigation relating to the SPAC’s acquisition of a health care technology company, which resulted in no charges
- an audit firm in connection with an SEC investigation into a cybersecurity incident at a public company
- a multinational financial institution in:
- a DOJ enforcement investigation into possible money laundering and know-your-customer compliance issues, which resulted in no charges
- a CFTC enforcement investigation into potential price manipulation in swap transactions related to debt issuances, which closed without charges
- a multinational company in parallel DOJ and SEC FCPA investigations, which resulted in no charges after the company’s compliance procedures and internal controls were enhanced
- an individual in an FCPA investigation, securing a favorable plea agreement resulting in a one-year term of probation
Ms. Libson maintains an active pro bono practice focusing on criminal defense and civil rights matters. She has represented several individuals facing federal narcotics trafficking and conspiracy charges and helped secure the acquittal at trial of an individual facing charges carrying a 10-year mandatory minimum sentence.
