Claire A. McCormack

Bio

Claire McCormack focuses her practice on complex commercial, intellectual property and securities litigation, representing clients in federal and state courts. Ms. McCormack’s experience includes representing:

  • the CEO of a company involved in computerized algorithmic trading of securities in connection with claims of trade secret misappropriation;
  • FedEx in connection with a pending federal criminal indictment alleging that the company conspired with certain online pharmacies to unlawfully distribute controlled substances and misbranded drugs. Ms. McCormack and the Skadden team received a 2017 California Lawyer Attorneys of the Year (CLAY) Award from the Daily Journal for their role in defending FedEx in this high-profile case;
  • SanDisk Corporation in a patent licensing dispute resulting in a $28.5 million jury verdict;
  • a multinational corporation regarding an internal investigation relating to allegations of improprieties in the IT security department;
  • an optical communications company in challenging the validity of an arbitration award under both the U.S. Federal Arbitration Act and the California Arbitration Act; and
  • current and former directors of PG&E in shareholder derivative litigation arising out of the San Bruno pipeline rupture.

Prior to joining Skadden, Ms. McCormack served as a law clerk to the Hon. Kenneth M. Karas in the U.S. District Court in the Southern District of New York. She subsequently served as an assistant district attorney in the San Francisco District Attorney’s Office, where she was the lead counsel in numerous jury trials and preliminary hearings.

Ms. McCormack is active in various pro bono initiatives. She was part of the Skadden litigation team that secured a successful settlement on behalf of a California state prisoner in a federal civil rights case. She previously served on the advisory board of nonprofit OneJustice.
