Ms. McElhaney has broad experience representing both borrowers and lenders in complex real estate financial transactions, including capital market and bank syndicated loans, construction loans, originations, participations, multi-tranche loan structures, mezzanine loans, intercreditor agreements, reorganizations and workouts. Her practice includes the representation of buyers and sellers of distressed properties, loans and investments; “loan to own” investors; and preferred equity investors. Her lending clients have included Fortress Investment Company, Deutsche Bank, JPMorgan Chase Bank, Credit Suisse, Goldman Sachs, Greenwich Capital, Norddeutsche LB and Area Property Partners. On the borrower side, she has represented real estate investment trusts; international corporations; railroad operating companies; private equity firms; and developers and owners of office buildings, hotels, shopping centers and apartment complexes.
In addition to her finance experience, Ms. McElhaney also has an active leasing practice. She has advised tenants in such significant lease transactions as New York City headquarters locations for The Leukemia and Lymphoma Society, Teach For America, HedgeServ LLC, Aircastle Advisor LLC, Griffon Corp., Indus Capital, Panavision (division of MacAndrews & Forbes), Mirae Assets Global Investments, The Street.Com and Oppenheimer & Co. She has handled office leases and subleases for Bank of America, First Capital LLC, Travelers, Credit Suisse, New York Board of Trade, Capital Printing and BlackRock. She also has represented clients in the negotiation of data center leases and mission critical facilities. Ms. McElhaney’s representation of landlords has included Wharton Properties (New York City flagship retail), Balazs Hotels (“celebrity chef” hotel restaurants), 950 Third Avenue (office), Tishman Speyer (celebrity chef restaurants and retail at Rock Center), Sumitomo Realty & Development (666 Fifth Avenue office and retail), Prudential Insurance (Times Square retail), the National Hockey League (retail), Park Tower Realty (office and retail), Solow Properties (office) and Gordon Homes (retail).
Ms. McElhaney also has significant experience representing clients in the acquisition, financing, development and disposition of office buildings, hotels, senior housing communities and data centers. Her clients include HEI Hospitality LLC, Sentinel Properties, The McGraw-Hill Companies, Chartwell Retirement Residences, Credit Suisse, The Bainbridge Group, The Richman Group of Florida, Dune Real Estate Funds, JPMorgan Chase Bank, The Georgetown Company, The Trump Group, Silverstein Properties, Balazs Hotels and Clarett Capital. She has specific experience in representing hospitality clients.
Her joint venture practice includes the representation of several Canadian insurance companies in ventures to make opportunistic acquisitions of mortgage-back securities; a private hotel fund in an investment to purchase defaulted hotel company mezzanine debt; Ian Schrager Hotels in a New York City hotel venture; an Australian industrial property owner entering the U.S. market; a South Korean corporate group in a New York City hotel development venture; and a national sports league in a venture to develop a sports-related, retail concept in Europe.
