Bio

Nicole Pacheco represents financial services, pharmaceutical, investment management, technology, insurance and health care companies in a wide range of complex civil litigation, confidential arbitrations and government/regulatory investigations.

Ms. Pacheco has defended clients in derivative lawsuits, shareholder litigations, putative class actions and other litigation matters in state and federal trial and appellate courts throughout the U.S. She has also represented clients in connection with investigations conducted by the Securities and Exchange Commission and various state regulatory agencies.

Ms. Pacheco’s representations include:

  • several investment management companies in defending against breach of contract, breach of fiduciary duty and Investment Company Act of 1940 claims by shareholders and activist hedge funds
  • a pharmaceutical company and certain of its officers and directors in defending against a securities class action regarding an FDA-approved drug
  • a financial services company in defending against an investigation by various state regulatory agencies
  • a retirement plan sponsor in defending against a putative class action alleging claims of breach of fiduciary duty under ERISA
  • a mortgage company in defending against a putative class action alleging violations of the Florida Telephone Solicitation Act and the Telephone Consumer Protection Act
  • a private equity firm in defending against a subpoena that involved matters pertaining to the EU’s General Data Protection Regulation
  • an energy company in negotiating and navigating contractual rights and available remedies regarding the development, construction and sale of renewable energy assets in the U.S.
  • an entertainment company in defending against a putative mass arbitration alleging violations of the Video Privacy Protection Act

Ms. Pacheco also maintains an active pro bono practice and has worked in coordination with the New England Innocence Project to counsel individuals who have been wrongfully convicted. She has also successfully represented individuals seeking asylum and secured sentencing commutations.
