Southwest Defeats Merger Challenge

Skadden represented Southwest Airlines in securing a dismissal with prejudice of an antitrust lawsuit challenging its $1.4 billion acquisition of AirTran Airways. The suit was filed by 43 individuals the day after the merger closed in May 2011. Following the plaintiffs’ unsuccessful interlocutory appeal, on November 30, Judge James Ware of the U.S. District Court for the Northern District of California granted Southwest’s motion to dismiss.
