Skadden secured another victory on behalf of Fresh Del Monte Produce Inc. in its lawsuit against Del Monte Corporation. Following a 2012 jury trial that found Del Monte Corporation had breached the parties’ license agreement by selling certain refrigerated fruits under the “Del Monte” trademark, on March 28, Judge Sidney Stein of the U.S. District Court for the Southern District of New York granted a permanent injunction for both the breach of contract and false advertising violations. The court also awarded Fresh Del Monte 9 percent prejudgment interest on the breach of contract claim, applying to sales dating back to 2002.
