PG&E Directors Secure Significant Appellate Win

Skadden secured a significant victory for current and former PG&E directors in shareholder derivative litigation arising from the September 2010 rupture of a natural gas transmission pipeline in San Bruno, California. On December 8, the California Court of Appeal granted a writ of mandate commanding the trial court to enter an order staying the litigation pending resolution of parallel federal criminal proceedings against the company, holding that the trial court applied an incorrect legal standard when it allowed the derivative litigation to go forward.
