SanDisk Wins Long-Running Antitrust Class Action

On April 29, 2016, a California federal judge granted SanDisk Corporations' bid to toss a certified antitrust class action by retailers accusing the company of unlawfully monopolizing the flash memory industry. Ritz Camera & Image LLC sued SanDisk in 2010 alleging a so-called Walker Process fraud claim, referring to the United States Supreme Court's 1965 decision in Walker Process Equipment Inc. v. Food Machinery and Chemical Corp., which established that enforcement of a fraudulently procured patent can give rise to an antitrust claim.
