Express Scripts Wins Dismissal of Shareholder Derivative Action

Skadden secured the dismissal of a shareholder derivative action filed against Express Scripts Holding Company and certain of its officers and directors. The case relates to the company's $15 billion contract dispute with Anthem, Inc. In August 2017, Skadden secured dismissal of a related securities fraud action against the company. Relying largely on that decision, on January 23, 2018, Judge Edgardo Ramos of the U.S. District Court for the Southern District of New York also dismissed this shareholder derivative action in its entirety.
