Kia Motors Corp. Secures 9th Circuit Affirmance of Trial Victory

Skadden represented Kia Motors Corporation and Kia Motors America, Inc. in securing an affirmance by the U.S. Court of Appeals for the Ninth Circuit of a previous trial victory in federal trademark infringement litigation brought by Allstate Insurance Company. The three-judge panel held that the district court was within its discretion when it found in 2017 that consumers are unlikely to confuse Kia’s “Drive Wise” vehicle add-ons with Allstate’s “Drivewise” insurance program and mobile phone app.
