Sempra Energy Directors Win Dismissal of Derivative Lawsuits

Skadden helped secure the dismissal of two shareholder derivative lawsuits brought against current and former members of the board of directors of Sempra Energy. The lawsuits were based on claims relating to the 2015 natural gas leak at a well located within Sempra subsidiary SoCalGas’ Aliso Canyon underground storage facility. On November 4, Judge Carolyn B. Kuhl of the Los Angeles County Superior Court dismissed the first plaintiff’s lawsuit for failure to make a pre-suit demand on the board and rejected the second plaintiff’s argument that his demand was wrongly refused by the board when it decided to await a government investigative report.
