Exceptional Trademark Case Warrants Fee Award for Pinduoduo

Skadden represented Pinduoduo, Inc. and affiliated companies in securing an award of nearly $400,000 in attorneys’ fees and costs in a trademark action brought by Beijing Daddy’s Choice Science and Technology Co. On February 13, Judge Naomi Buchwald of the U.S. District Court for the Southern District of New York said that Skadden’s arguments fulfilled all four of the relevant factors under the Lanham Act’s analysis to establish that this was an “exceptional case” and that the requested legal fees and costs were therefore warranted.
