Skadden represented Pinduoduo, Inc. and affiliated companies in securing the dismissal of claims for trademark infringement and unfair competition brought by the Chinese baby care company Beijing Daddy’s Choice Science and Technology Co in the Southern District of New York. The plaintiff alleged Pinduoduo unlawfully facilitated Chinese merchants’ sale of unauthorized Daddy’s Choice-branded diapers to U.S. customers. The court held that the exercise of personal jurisdiction over Pinduoduo would violate constitutional due process.
