Skadden secured the dismissal with prejudice of all claims against Carbonite, Inc. and certain of its former officers in a putative securities fraud class action alleging that the company misled investors about its new data backup product, Server Backup VM Edition, which the company withdrew from the market after nine months. U.S. District Judge Leo T. Sorokin agreed with our arguments and determined that the plaintiff failed to allege scienter.
