On August 26, Skadden hosted the webinar “Tariff Refund Class Actions and Mass Arbitrations: Defensive Strategies and Related Risk Mitigation,” which examined the implications of a recent U.S. Supreme Court decision — that certain tariffs imposed by the federal government under the International Emergency Economic Powers Act were unlawful — for retailers and consumer-facing companies. In light of this decision, the panelists discussed the nature of recent claims and theories of liability, strategies for invoking arbitration agreements and class action waivers, and mass arbitration risks and brand reputation protections, among other topics.
