In this edition of our Privacy & Cybersecurity Update, we look at a series of recent court rulings regarding standing in privacy cases, most of which suggest plaintiffs will continue to have a difficult time establishing standing. We describe the FCC's recent stay in the implementation of new privacy rules for ISPs that had been announced under the Obama administration. We also examine a possible shift in the FTC's definition of actionable injury, new dispute resolution procedures under the Privacy Shield and the timelines for compliance with the New York Department of Financial Services' cybersecurity regulations for financial institutions. Additionally, we discuss a Harvard Business Review report analyzing corporate boards' awareness of cybersecurity preparedness.
