Stephen Della Penna focuses his practice on contested restructuring matters.
Mr. Della Penna represents a broad spectrum of clients in a wide variety of restructuring matters in federal courts across the country. His experience covers all facets of the in-court bankruptcy process, including first day hearings, sale hearings, disclosure statement and confirmation hearings, adversary proceedings, fraudulent transfer and preference actions, and related appeals in both federal district and circuit courts. Mr. Della Penna also maintains a practice in the Delaware state courts, including the Delaware Court of Chancery.

- 23andMe’s founder in her purchase of the company out of bankruptcy in a Section 363 sale
- Endo Pharmaceuticals in its Chapter 11 restructuring
- Exide Technologies in its Chapter 11 restructuring
- UBS in matters related to the Commonwealth of Puerto Rico’s PROMESA restructuring
- PPL Corporation and certain of its current and former directors in an alleged fraudulent transfer dispute arising out of a spin-off of its coal-fired business
- Stearns Holdings, LLC in its Chapter 11 restructuring
- Clear Blue as a member of the Official Committee of Unsecured Creditors in the Vesttoo Chapter 11 restructuring
- Noble Corporation plc in its Chapter 11 restructuring
- The independent director of Samson Resources in his investigation of claims during Samson’s Chapter 11 restructuring
- Toshiba in matters related to the Chapter 11 restructuring of Westinghouse, its then-subsidiary
