Bio

Adam Kochman represents clients in connection with a broad range of antitrust issues in complex litigations, government investigations, and mergers and acquisitions. He has worked for clients in a diverse range of industries, including technology, travel, sports, and oil and gas.

In the antitrust litigation area, Mr. Kochman has handled cases involving price fixing, group boycotts, monopolization and other restraints of trade, as well as class actions. Some of Mr. Kochman’s recent antitrust litigation experiences include representing:

  • Greystar in antitrust class actions and actions by state attorneys general alleging that multifamily property managers inflated rents through the use of revenue management software
  • Sabre Corporation in the successful defense at trial against claims for unlawful monopolization and unreasonable restraints of trade brought by US Airways. After a three-week trial, a jury found Sabre not liable on one claim and awarded $1 in damages on the other claim; and a breach of contract case against Hawaiian Airlines
  • The PGA TOUR in several matters involving LIV Golf, including claims by LIV and several professional golfers alleging violations of antitrust law
  • Interfor Corporation in the successful dismissal of price-fixing and monopolization claims brought by three construction companies in the lumber market
  • LVMH Moet Hennessy-Louis Vuitton in litigation regarding its proposed acquisition of Tiffany & Co.

Mr. Kochman also has represented clients in numerous acquisitions, including:

  • Stryker Corporation in its $5.4 billion acquisition of Wright Medical Group
  • Visa Inc. in its proposed $5.3 billion acquisition of Plaid Inc.
  • Veritas Capital in its $2.8 billion acquisition of Cubic Corporation
  • Devon Energy in its merger of equals with WPX Energy, Inc.
  • Southwestern Energy in its:
    • $2.7 billion acquisition of Indigo Natural Resources, LLC
    • $849 million acquisition of Montage Resources

Mr. Kochman also provides general antitrust counseling and has advised clients on a variety of matters, including joint ventures, strategic alliances, unilateral conduct, and pricing and distribution issues.
