Bio

Joshua O’Brien focuses his practice on complex civil litigation, including high-stakes commercial disputes, class actions and government investigations. Mr. O’Brien has represented clients in state and federal courts, as well as in private arbitration, and has been involved in all stages of the litigation process, from pre-litigation resolutions and pleading-stage dismissals to summary judgment, trial, post-judgment proceedings and appeals. He has represented emerging and established companies in the technology, finance, real estate, automotive and health care sectors. Some of his notable representations include:

  • fiduciaries engaged in multidistrict litigation concerning control and management of a billion-dollar real estate enterprise
  • an architectural and infrastructure design firm in a contract dispute concerning a multibillion-dollar construction project
  • a foreign consumer vehicle automaker in a federal multidistrict class action involving product liability and breach of warranty claims
  • shareholders and officers of a health care company in an action arising from an acquisition involving allegations of breach of contract, fraud and noncompete agreement violations
  • a major multinational fast-food franchise in a series of disputes with franchisees and commercial partners
  • an international commercial truck manufacturer in a dispute involving allegations of product liability and breach of warranty claims
  • a corporate automotive group in arbitration concerning the purchase of commercial real estate
  • investors and commercial real estate developers in disputes related to investment transactions and project management
  • owners of a limited liability company in an internal dispute over the management and control of a large cattle ranching and farming operation spanning tens of thousands of acres

Before entering private practice, Mr. O’Brien earned a master’s degree in international business and trade and taught English in Madrid.
