Vodafone Secures Landmark Victory in Arbitration Dispute

Skadden obtained a landmark victory, one of the largest ever in an international arbitration, for Vodafone International Holdings BV in its $5.5 billion dispute with India. The Hague tribunal ruled that India’s attempt to impose onto Vodafone a retrospective withholding tax demand of $5.5 billion (including penalties and interest) violated India’s obligations under the India-Netherlands Bilateral Investment Treaty. It also held that any further attempt by India to enforce the demands against Vodafone would violate international law.
